Bail in NSW – What You Need to Know

Understanding the Bail Act 2013

Bail allows a person charged with an offence to remain in the community while awaiting court, subject to conditions. The Bail Act 2013 uses a risk-based approach to determine whether bail should be granted.

The court considers factors such as:

  • Seriousness of the offence

  • Strength of the prosecution case

  • Prior convictions and bail history

  • Risk of failing to appear

  • Risk of further offending or interfering with witnesses

Show Cause Offences

For certain serious offences, the accused must show cause as to why their detention is not justified.

Bail Conditions

Conditions may include reporting to police, curfews, residence requirements, or compliance with AVOs.

Failure to comply can result in bail being revoked.
