What Police Can and Can’t Do

The Law Enforcement (Powers and Responsibilities) Act 2002 sets out police powers relating to searches, questioning, and arrest.

Can police search you without a warrant?

Yes – but only if they have a reasonable suspicion that you are carrying illegal items. They cannot search you without a lawful reason.

Do you have to answer police questions?

You must provide your name and address, and sometimes your date of birth. You generally do not have to answer other questions.

An exception applies if your vehicle is involved in a serious offence – you must disclose the driver and passengers.

If you are arrested

You have the right to:

  • Be told why you are being arrested

  • Remain silent

  • Contact a lawyer

  • Decline an interview without legal advice

Police body-worn cameras are commonly activated during interactions and can be used as evidence.
